Terms & Conditions

  1. Kickstart Arts and its staff shall not be liable for any loss or damage sustained by the hirer or by any person, firm or corporation supplying any hirer.

  2. Confirmation of booking is subject to the receipt of a signed acceptance by the hirer of these Terms and Conditions and payment as specified in the Schedule of Fees.

  3. The venue is available for hire from 7am–11pm every day. If your event is outside Kickstart’s business hours of 9am–5pm Monday to Friday, you may need to visit during business hours to arrange access.

  4. Noise restrictions apply.  There is to be no amplification from 9am to 5pm in most venues, and past 11:00pm on weekdays (Monday-Friday), and there is to be no activity past 11pm on any day.

  5. Music is permitted by prior arrangement. In order to prevent as far as possible noise from the hirer's function becoming audible to people in other areas of the Venue and thereby causing unrest and disturbance, the Hirer shall undertake that all doors in the hired portion leading into any foyer and/or passageway are kept closed.

  6. If bringing your own production equipment to the venue, you will need to provide your own technical support. If hiring any Kickstart production equipment, we can provide technical support at the rates outlined in the Schedule of Fees.

  7. The hirer shall vacate the venue by the agreed time of the expiration of the period of hire.

  8. All goods, properties or materials brought in by, or on behalf of the hirer, must be removed from the venue by the expiration of the period of hire. All rubbish and recycling must be removed. Failure to comply with this condition will incur an additional charge.

  9. The venue must be left by the hirer in reasonable clean condition, as at the commencement of the hire. Failure to do so will incur additional cleaning charges. A monetary bond may be requested in advance.

  10. No nails, screws, adhesive tapes, or any fastening may be driven into or attached in any way to walls, doors, glass, floors, furniture or fittings. Signage, additional structures or furniture that will put at risk any Kickstart original materials on display cannot be installed by hirers. Signage must meet the approval of Kickstart Arts.

  11. Venues are hired with any current exhibition or display intact which includes audiovisual and exhibition structures, pictures, signage and display cases. Interference with or alteration of any of these or any other electrical installations, lighting sound systems or other property is prohibited.

  12. No smoking, smoke machines, naked flame or animals are permitted within the premises.  Smoke machines and Hazers can be used in the Hidden Theatre if a permit is obtained well in advance.  

  13. Children must be supervised at all times.

  14. The hirer shall be responsible for the cost of making good any damage caused to the building, furniture fittings and equipment arising out of and in the course of the hirer's function: Reasonable wear and tear expected. The hirer will inform Kickstart Arts of any damage or breakages.

  15. Prior to delivery, all deliveries for the function must be arranged with and approved by Kickstart, and delivery personnel are to follow any directions or instructions given by Kickstart.

  16. The hirer shall conform to the requirements of the Local Government Act and any other relevant acts, by-laws, rules or regulations, made thereunder and shall be liable for any breach of any such acts, by-laws, rules or regulations.

  17. The Hirer hereby indemnifies Kickstart Arts and agrees to keep the venue, and its staff indemnified against all actions, suits, proceedings, claims and demands, costs and expenses whatsoever, which may be taken or made against Kickstart or its staff incurred arising out of the death of or injury to any person or damage to or loss or any property.

  18. No liquor is to be brought into the venue without Kickstart permission and an appropriate liquor licence.

  19. Kickstart Arts requires the Responsible Service of Alcohol as follows:

    • ​Liquor will not be sold or supplied to a person or persons under the age of eighteen years

    • Proof of age must be provided on request

    • Kickstart Arts will not permit intoxication or any indecent, violent or quarrelsome conduct on the premises

    • Liquor will not be sold or supplied to any person or persons who are at the time in a state of intoxication. Accordingly, patrons will be denied service if they are considered to be intoxicated.

  20. Kickstart Arts reserves the right to refuse entry or ask any of the Hirer's invitees to leave the premises.

  21. Kickstart Arts reserves the right to cancel a booking. Kickstart Arts shall not be liable in any way for any loss or damage to the hirer or any third party in consequence of the exercise of this right. In such circumstances any amount paid on account of fees will be refunded however, no interest shall be payable thereon.

  22. As part of your hire agreement, you agree to provide Kickstart Arts with 3 images of your event and grant us the rights to use them for reporting, evaluation and promotional purposes of Kickstart Arts. You also agree that Kickstart Arts may take photos of your event to be used for reporting, evaluation and promotional purposes for Kickstart Arts and community arts and culture in general. You will notify us of people at your event who do not wish to have their image used for promotional purposes.

  23. Kickstart’s facilities are hired on the rules and condition above mentioned and the payment by any person of any fees, and charges for such facilities, and issue to any such person of a receipt or sum and/or confirmation of hire shall be deemed to be acknowledgement and acceptance by such person of the conditions herein contained.

  24. The Parties agree:

    • The Hirer is responsible for the observance of the terms and conditions of hiring Venue rooms and the payment of all fees and charges arising from the hire.

    • Invoices for Venue hire are payable within 7 days from the end of the venue hire period.

    • Payments can be made by direct credit (EFT), cheque or cash.

    • In the event of cancellation of the function, the following fees will apply:

      • Cancellation made fourteen (14) days or more prior to the function date, no fee will apply

      • Cancellation made less than fourteen (14) days prior to your function, the 50% of the venue hire fee is payable

We value your visit, whether it's online or at the Kickstart Arts Centre, and want to make sure there are no uncertainties or misunderstandings about what we provide, what you expect from Kickstart Arts, and what we expect from you as a Visitor to our Website or as a Venue Hirer.

1. Definitions

“Venue Hire”, “our”, “us”, or “we” refers to Kickstart Arts' business of hiring out our venues as branded by Kickstart Arts Inc. and promoted on the Kickstart Arts Website.  “Community Venues” is an ongoing project which is promoted, managed and produced solely by Kickstart Arts Inc.

“our Website” refers to any websites located at the domain https://www.kickstartarts.org/

 

“Hirer” means a person who arranges to use one or more rooms at the Kickstart Arts Precinct at 12 St Johns Avenue, St Johns Park, New Town 7008 

​

“Venue” means the place where the Hirer's activity will be held at a designated and agreed time.

​

These terms will be capitalised throughout this Agreement.

 

2. Description of Kickstart Arts' Community Venues Terms and Conditions

(a) Kickstart Arts Inc. Kickstart Arts Inc. provides access to numerous indoor and outdoor spaces to hire to mambers of the community, businesses, GOs and NGOs.

(b) Any person who decides to use our Website and/or book one of our Venues for hire must agree to and comply with the following Terms and Conditions. This Agreement applies to both the use of this Website and the booking of our Venues.

 

(c) These Terms and Conditions are in addition to any agreements, contracts or other documents that a Hirer may enter into.

 

3. Amendments to Terms and Conditions

(a) We may amend these terms at any time, and it is your responsibility to check for updates periodically.

 

(b) The amended Terms and Conditions are effective immediately from the date they are posted on our Website.

 

(c) Your continued use of our Website following an amendment will represent an agreement by you to be bound by amended Terms and Conditions.

 

(d) If you do not agree to these Terms and Conditions then you are not authorised to use our Website and/or be a Hirer of one of our Venues.  If there is anything within these Terms and Conditions that you would like to talk about, please feel free to contact us.

4. Copyright

(a) Copyright on our Website (including, but without limitation, text, graphics, logos, icons, videos, music, sound and links) is owned or licensed by us.

(b) Subject to the conditions prescribed under the Copyright Act 1968 (Cth) (and similar legislation which applies in your location), and except as expressly authorised by these Terms and Conditions, without our prior written permission you may not:

    (i) Adapt, reproduce, store, distribute, print, display, perform, publish, sell, transfer, exploit or create derivative works from any part of our Website;

   (ii) Commercialise any information, products or services obtained from any part of our Website.

However, the contents of our Website may be downloaded, printed or copied for your personal non-commercial use, or if you are a Facilitator for purposes which are necessary to our business relationship..

 

5. Trademarks

(a) Except where otherwise specified, any word or device to which is attached the TM or ® symbol is a registered trademark.

(b) If you use any of our trademarks in reference to our activities, products or services, you agree to include a statement attributing that trademark to Kickstart Arts Inc. You must not use any of our trademarks:

    (i) In or as the whole or part of your own trademarks;

    (ii) In connection with activities, products or services which are not ours in a manner which may be confusing, misleading or deceptive;

    (iii) In a manner that disparages us or our information, products or services (including our Website).

 

6. Other Intellectual Property

(a) All materials provided to you by us, and any intellectual property belonging to or associated with Kickstart Arts Inc. including any Website content, logo, text, documentation and graphics are the sole property of Kickstart Arts Inc. or our Facilitators, and you agree that you will not infringe any rights in any way. This includes, but is not limited to, commercial use of the materials and distribution or the materials to other parties.

 

7. Links to other Websites

(a) Our Website may contain links to other internet sites for information purposes. Those links are provided for your convenience to provide further information. As we are not responsible for the information and material on these linked websites, we strongly advise you read the Terms and Conditions of any third-party website you visit.

(b) Our links to other websites should not be construed as an endorsement, approval or recommendation by us of the operators of those linked websites unless it is expressly stated.

 

8. Emails

(a) If we believe we have the legal requirement to do so, we will preserve the content of any email you send us. We may monitor your email message content for trouble-shooting or maintenance purposes, or if any form of email abuse is suspected.

 

9. Security of Information

(a) While we try to ensure that our Website is secure, we cannot guarantee the security of your personal information, nor that the website is free from viruses or similar matters.

(b) While we strive to protect any information sent to Kickstart Arts Inc., we do not warrant and cannot ensure the security of any information you transmit to us, and this is transmitted at your own risk. Nevertheless, once we receive your transmission, we will take reasonable steps to preserve the security of the information received.

 

10. Accuracy of Information

(a) Keeping the information on this website accurate and up to date is one of our highest priorities. However, while we try and ensure that it is accurate, reliable, timely and complete, we do not accept liability for any inaccurate, unreliable, untimely or incomplete information contained therein, or for any reliance placed on it by you.

(a) You agree to use this website in line with these Terms and Conditions, and for lawful purposes. You agree to comply with all applicable laws, regulations and codes within Australia or any other jurisdiction from which you are accessing our Website. In particular, you agree that you will not:

    (i) Use our Website in a manner which causes or may cause an infringement of the rights of any other person or which violates any applicable law or regulation;

    (ii) Make any unauthorised, false or fraudulent bookings;

    (iii) Use any software or device to interfere with the operation and look of our Website, or to breach its security. We reserve the right to restrict or prohibit your access to our Website at any time and for any reason. If you violate any of these terms, your permission to use our Website shall terminate immediately without the necessity for any notice.

Your privacy is very important to us, and we’d like to assure you that we are committed to protecting your privacy. We have developed this policy to explain how we collect, use, communicate and disclose, and make use of any personal information. Our privacy policy is as follows:

 

(a) We may collect Website visitors’ contact information (such as, but not limited to, email addresses and photos taken during classes). Unless you object, this information may be used:

    (i) To send news, information about your Session, our activities and general promotional material which we believe may be useful to you;

    (ii) To monitor who is accessing the Website or using services offered on the Website and to profile the type of people accessing the Website.

 

(b) If you provide us with any personal data relating to a third party (eg information of your spouse, friends) by sharing that with us, you have displayed that you have obtained consent from the third party to do so.

 

(c) We will only share your details within our organisation and among our employees and appointed representatives such as the Facilitator where necessary.

(e) We will hold your personal information for as long as we need to in order to comply with our legal obligations. 

 

(f) We will endeavour to ensure that the information you provide us with is kept private and confidential, and we will only use it to provide the services you request. However, we cannot absolutely guarantee the security of your personal data.

(h) This Website uses cookies, which enables us to monitor traffic in an effort to serve you more efficiently if you return to our Website.
